By accessing and using this website and purchasing products from us, you agree to be bound by the following terms and conditions. Please read them carefully.

 

1. Definitions * "Website" refers to www.ocean2outbackimagery.com. * "Photographer" or "We" refers to Flynn Drage / Ocean 2 Outback Imagery. * "Customer" or "You" refers to the individual or entity purchasing products from the Website. * "Products" refer to the photographic prints and other items available for sale on the Website. * "Image(s)" refers to the photographic works, whether digital or physical, created by the Photographer.

 

2. Intellectual Property and Copyright

2.1. All Images and content on this Website are the exclusive property of the Photographer and are protected by copyright laws. The Photographer retains all rights, title, and interest in and to the Images.

2.2. When you purchase a print, you are purchasing the physical product itself. The purchase does not transfer any copyright or ownership of the Image to you.

2.3. The Images may not be reproduced, duplicated, copied, sold, resold, or exploited for any commercial purpose without the express written permission of the Photographer.

2.4. You are granted a non-exclusive, non-transferable license to use the purchased print for personal, non-commercial display only. This license does not permit you to:* Reproduce, scan, or create digital copies of the print.* Use the Image for any commercial, promotional, or advertising purposes.* Sell, re-sell, license, or sub-license the print or the Image.* Use the Image in any way that suggests an endorsement or affiliation with any product, service, or company.

2.5. The Photographer reserves the right to use any of the Images for self-promotion, including but not limited to, display on the Website, social media, exhibitions, competitions, and portfolios.

 

3. Product Information and Pricing

3.1. We make every effort to ensure that the information, descriptions, and images of the Products are as accurate as possible. However, we do not warrant that the product descriptions or other content of this Website are accurate, complete, reliable, current, or error-free.

3.2. All prices are listed in AUD and are subject to change without notice. Prices displayed at the time of purchase are final.

3.3. While we strive to ensure all pricing is correct, a small number of items may contain pricing or typographical errors. We reserve the right to correct any such errors and to refuse or cancel orders placed at the incorrect price.

 

4. Orders and Payment

4.1. All orders are subject to acceptance by the Photographer. We reserve the right to refuse or cancel any order for any reason, including but not limited to, product availability, errors in pricing or product information, or if we suspect fraudulent activity.

4.2. Payment must be made in full at the time of purchase. We accept the following payment methods: Credit Card, PayPal, Bank Transfer or Cash.

4.3. Your payment information is handled securely by our third-party payment processor, and we do not store your credit card details.

 

5. Shipping and Delivery

5.1. Products are generally made to order. Please allow 14 business days for production before shipping. Shipping times are estimates and may vary depending on the destination.

5.2. Shipping costs will be calculated at checkout. We are not responsible for any customs duties, taxes, or fees that may be incurred upon delivery to international destinations.

5.3. We take all reasonable care to package prints securely. However, we are not responsible for any damage, loss, or delay that occurs during transit. If a print is damaged upon arrival, please see our returns policy.

5.4. It is your responsibility to provide a correct and complete shipping address. We are not responsible for orders delivered to an incorrect address provided by the customer.

 

6. Returns and Refunds

6.1. Due to the custom, made-to-order nature of our prints, all sales are considered final. We do not offer refunds or exchanges for change of mind.

6.2. If a print arrives damaged or there is a significant defect, you must contact us within 7 days of receiving the order. You must provide photographic evidence of the damage or defect.

6.3. Upon review, we will, at our sole discretion, offer a replacement print or a refund. We may require you to return the damaged print for further assessment. Return shipping costs for damaged items will be covered by us.

 

7. Limitation of Liability

7.1. To the fullest extent permitted by law, the Photographer and Ocean 2 Outback Imagery shall not be liable for any indirect, incidental, special, or consequential damages arising from the use of this Website or the purchase of any Product, even if we have been advised of the possibility of such damages.

7.2. Our total liability for any claim arising out of or relating to your use of this Website or the purchase of a Product shall not exceed the total amount paid by you for the specific Product giving rise to the claim.

 

8. Governing Law

8.1. These terms and conditions are governed by and construed in accordance with the laws of Western Australia. Any disputes arising from these terms and conditions or your use of the Website shall be subject to the exclusive jurisdiction of the courts of Western Australia.
